On the radio program, Andrés Peralta shared a raw account of his struggle with the justice system to be reunited with his son.

“The Justice System Took Him Away”

At the start of the conversation in the studio, Andrés Peralta explained why he was separated from his son: “I haven’t been able to see my son for five years; the justice system took him away and prevents me from seeing him. I was living with a partner, and in 2019, on August 5, I received a surprising order stating that I had to leave my home and was being excluded. From that moment on, I lost all contact with my son. There was never any verification of any kind to justify that measure.”

“Two years later, I found out through neighbors, with whom I never lost contact and who always kept me informed about what was happening because I wanted to know if they saw him and how he was, that they hadn’t seen him for a while. So, I started to investigate what was happening and found out that he had been transferred to a home in Once because there was a report, made by one of the aunts, claiming that the mother and her partner at that time were physically and psychologically abusive, so he was removed and ended up in this Jewish home,” he elaborated.

In response to a question from the panel, he detailed that “I was accused of gender violence” and that “obviously, the two subsequent years showed that the report made against me had nothing to do with me; the person who was violent was the one from whom the child was taken.”

The Legal Battle

He continued: “From there, I contacted lawyers, and this process began where we always requested to speak with the judge. The judge at that time denied us the opportunity to speak with her three times, saying that it was not the right moment.”

“Now that judge is no longer there, and there is a new one who, about 20 days ago, I believe was the last straw, issued a report outlining the benefits of the Jewish religion and of putting my son up for adoption. For society and the justice system, I have been dead for five years, and nothing is said about me,” he developed.

He also noted that “in some comments, my son said that he didn’t want to return home and that if that happened, he would run away and didn’t want to have anything to do with his mother, grandmother, and sister,” but that “he never mentioned anything about me. At that time, he was 8 years old, and now he is a teenager. Since then, I have never had any contact with him.”

Reported Irregularities

In the final part of his raw account, Peralta criticized the home: “He is currently in a home where there are a number of irregularities that would take hours to mention. They say that this boy has advanced significantly and that he is progressing in a good, happy, and calm environment. However, the psychologists did not notice an important detail that I requested from Hospital Posadas, where he was treated, and they kindly provided it to me. As a child, he showed a slight developmental delay.”

“The specialists who saw him told me at the time not to worry, that he needed to develop in a calm, loving, and supportive home, and as he grew, he would catch up with other children his age. He was two years behind the normal age.”

To close, he noted that “he did not receive what was recommended: a home where he was treated well and supported” and that “I was always a present father, and he was always with me. Every word I say is verifiable because I have photos, videos, and chats.”
